Kevin Yellow Earring, Assault with a Dangerous Weapon, New York 2023

A brutal assault in Eagle Butte, South Dakota, has landed 26-year-old Kevin Yellow Earring in hot water, as he now faces charges of Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury.

According to prosecutors, the alleged attack occurred on February 11, 2017, leaving one of the victims with serious injuries. The maximum penalty upon conviction is up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and up to $300 to the Federal Crime Victims Fund.

The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services, with Assistant U.S. Attorney Jay Miller handling the case. Yellow Earring was remanded to the custody of the U.S. Marshals Service pending trial.

Yellow Earring, who pleaded not guilty to the Indictment, appeared before U.S. Magistrate Judge Mark A. Moreno on March 16, 2017. The Indictment alleges that Yellow Earring assaulted two adults on February 11, 2017, causing serious injuries to one of them.

The charges are merely accusations, and Yellow Earring is presumed innocent until and unless proven guilty. A trial date has not been set.
