Guillermo Aybar-Guerrero, Fentanyl Distribution Conspiracy, Massachusetts 2020

BOSTON – In a shocking turn of events, two brothers from the Dominican Republic, Guillermo Aybar-Guerrero, 28, and Luis Aybar-Guerrero, 24, have been indicted on federal charges for their alleged involvement in a fentanyl distribution conspiracy.

According to the indictment, the brothers, who resided in Lawrence, Massachusetts, were charged with one count of conspiring to distribute and to possess with intent to distribute fentanyl and one count of possession with intent to distribute fentanyl. The charges stem from a series of controlled purchases of fentanyl made by investigators in June 2020.

Details of the investigation reveal that on June 10 and 17, 2020, investigators conducted controlled purchases of fentanyl from Guillermo Aybar-Guerrero. A third controlled purchase was set up on June 25, 2020, which resulted in Guillermo‘s arrest. At the time of his arrest, he was found in possession of approximately 30 grams of suspected fentanyl, which he allegedly retrieved from his brother, Luis.

A subsequent search of Luis Aybar-Guerrero‘s residence led to the seizure of an additional 263 grams of fentanyl, as well as a scale, baggies, and other drug-distribution paraphernalia. The sheer quantity of fentanyl seized in this operation underscores the severity of the charges faced by the Aybar-Guerrero brothers.

The charges of conspiracy to distribute and to possess with intent to distribute 40 grams or more of fentanyl, and possession with intent to distribute of 40 grams or more of fentanyl carry a mandatory minimum sentence of five years and a maximum of 40 years in prison. Additionally, the brothers face at least four years of supervised release and a fine of $5 million. The sentences will be imposed by a federal district court judge based on the U.S. Sentencing Guidelines and other statutory factors.

The case is being prosecuted by United States Attorney Andrew E. Lelling’s Narcotics and Money Laundering Unit. The investigation was conducted by the Drug Enforcement Administration, New England Field Division, with Special Agent in Charge Brian D. Boyle at the helm. The announcement of the indictment was made jointly by Lelling and Boyle, highlighting the collaborative efforts of law enforcement agencies in combating drug trafficking.

It is essential to note that the details contained in the indictment are allegations, and the defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law. As the case progresses, the prosecution will need to prove the charges against Guillermo Aybar-Guerrero and Luis Aybar-Guerrero beyond a reasonable doubt to secure a conviction.
