LAREDO, Texas – A brazen attack on a federal agent ended with a 15-month prison sentence for Marco Cupil-Hernandez, a 21-year-old Mexican citizen. U.S. Attorney Nicholas J. Ganjei announced the sentencing following a guilty plea from Cupil-Hernandez, who admitted to repeatedly striking the Border Patrol agent while attempting to evade custody.
The incident unfolded January 23rd, after Cupil-Hernandez illegally crossed the Rio Grande into the United States. Immediately detained by authorities, he feigned injury, leading to transport to a local hospital. Despite being cleared for release – though still limping – Cupil-Hernandez launched a violent escape attempt as the agent assisted him into a vehicle. What began as a push quickly escalated into a full-blown struggle on concrete.
Details revealed in court paint a disturbing picture. Each time the agent attempted to restrain Cupil-Hernandez, the defendant actively stripped away the officer’s grip, discarding articles of clothing until he was down to his underwear and shoes. He then escalated the violence, elbowing the agent in the face, momentarily breaking free and fleeing the scene in a near-naked state. The agent sustained injuries to his knee and back during the struggle.
The pursuit was short-lived. Authorities quickly located Cupil-Hernandez hiding under covered parking at a nearby gym. During sentencing, U.S. District Judge John A. Kazen dismissed Cupil-Hernandez’s claims of merely wanting to escape, stating the evidence indicated a deliberate intent to fight. The judge handed down the 15-month sentence, with deportation proceedings expected to follow his imprisonment.
This case is part of “Operation Take Back America,” a nationwide Department of Justice initiative aimed at combating illegal immigration and dismantling transnational criminal organizations. The operation leverages resources from the Organized Crime Drug Enforcement Task Forces and Project Safe Neighborhood. The FBI led the investigation, with crucial assistance from Border Patrol and Customs and Border Protection Air and Marine Operations. Assistant U.S. Attorney Homero Ramirez prosecuted the case.
Cupil-Hernandez remains in custody pending transfer to a Federal Bureau of Prisons facility.
