Box Elder Man Charged With Failure To Register As A Sex Offender
A 54-year-old Box Elder man has been indicted by a federal grand jury for Failure to Register as a Sex Offender, according to U.S. Attorney Brendan V. Johnson.
Gerald Davis, also known as Jerry Davis, was indicted on March 18, 2014, and appeared before U.S. Magistrate Judge Veronica L. Duffy on July 14, 2014. He pled not guilty to the Indictment.
The maximum penalty upon conviction is 10 years in custody and/or a $250,000 fine, a lifetime of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The charge relates to Davis failing to register as a convicted sex offender between September 6, 2013, and March 18, 2014, in South Dakota.
The charge is merely an accusation and Davis is presumed innocent until and unless proven guilty.
The investigation is being conducted by the U.S. Marshals Service. Assistant U.S. Attorney Eric Kelderman is prosecuting the case.
Davis was remanded to the custody of the U.S. Marshals Service pending trial, which has been set for September 16, 2014.
