Brooklyn Shooting: Cops Justified in Killing Christopher Ferguson

BROOKLYN, NY – Christopher Ferguson, 33, is dead after a December 5, 2024, shootout with New York City Police Department officers in Brooklyn, and the Attorney General’s Office isn’t pressing charges. NY Attorney General Letitia James’ Office of Special Investigation (OSI) released a Notification of Investigative Findings today, stating that prosecutors lack sufficient evidence to disprove the officers’ use of deadly force was justified. The incident stemmed from a reported shooting and a high-speed chase that ended with Ferguson pointing a loaded firearm at police.

The chaos began shortly before 3:00 PM when NYPD officers responded to a ShotSpotter activation at 81 North Portland Avenue. A witness quickly provided a description of the vehicle involved and its license plate. Officers spotted the car at 3:11 PM traveling eastbound on Fulton Street and attempted a traffic stop. The driver, whose identity has not been released, blew through the stop and led officers on a pursuit that ended when traffic clogged the intersection of Utica Avenue and Park Place.

According to the OSI report, as officers approached the vehicle on foot, Ferguson suddenly opened the front passenger door and brandished a firearm, aiming it directly at the responding officers. Two officers immediately returned fire, striking Ferguson. He was rushed to a local hospital, but succumbed to his injuries. A loaded handgun with an extended magazine was recovered at the scene. The three-year-old child seated in the back of the car was thankfully unharmed.

The driver of the vehicle, however, wasn’t so lucky. After being tackled and handcuffed, she sustained two gunshot wounds and other minor injuries. She now faces charges of Reckless Endangerment in the First Degree, and related offenses, due to the blatant risk she posed to her young son. That case is being prosecuted by the Brooklyn District Attorney’s office. OSI confirmed the incident was captured on both body-worn camera and dashboard footage.

OSI’s mandate, as outlined in New York State Executive Law Section 70-b, requires a thorough investigation into any death potentially caused by the actions of a law enforcement officer. This includes on-duty and off-duty officers, armed or unarmed subjects, and regardless of custody status. While a full Investigation Report will be released at a later date, OSI has determined that, based on the evidence gathered, a successful prosecution is unlikely.

The Ferguson shooting adds another layer to the ongoing debate surrounding police use of force and the ever-present tension between officer safety and civilian lives. While the AG’s office has cleared the officers, the incident will undoubtedly fuel further scrutiny of NYPD tactics and the role of technologies like ShotSpotter in escalating potentially volatile situations. The question remains: was this a justified shooting, or a tragedy waiting to happen?
