Brule Woman Faces Federal Assault Charges

GRIMY TIMES EXCLUSIVE: A Lower Brule, South Dakota woman is facing serious federal charges after an alleged attack on a Federal Bureau of Investigation (FBI) agent. Majestic Byington, 23, was indicted by a federal grand jury for Assaulting, Resisting, and Impeding a Federal Officer.

According to the United States Attorney’s Office, Byington was charged on August 16, 2016, with the heinous act that occurred on April 15, 2016. She faced U.S. Magistrate Judge Mark A. Moreno on February 2, 2017, where she entered a not guilty plea.

The severity of her charges is evident in the potential penalties: up to eight years behind bars and/or a $250,000 fine await Byington if convicted. Additionally, she could be sentenced to three years of supervised release, a $100 contribution to the Federal Crime Victims Fund, and may be ordered to pay restitution.

The indictment paints a picture of a violent encounter; it is alleged that Byington assaulted, resisted, opposed, impeded, intimidated, and interfered with an FBI Special Agent while he was executing his duties. As with all criminal charges, Byington is presumed innocent until proven guilty in a court of law.

The investigation into the matter is being conducted by the Bureau of Indian Affairs, Lower Brule Agency. Assistant U.S. Attorney Meghan N. Dilges is leading the prosecution against Byington. Currently, she remains in the custody of the U.S. Marshals Service pending trial, with no trial date yet announced.
