A Buffalo man was sentenced to 27 months in prison for being a felon-in-possession of a firearm, according to a statement from the U.S. Attorney’s Office.
Andre Baker, 28, of Buffalo, was convicted of the charge after an investigation by the Buffalo Police Department and the Bureau of Alcohol, Tobacco, Firearms, and Explosives.
On March 25, 2018, Baker was involved in a physical fight outside Arthur’s Pub in the vicinity of Jefferson Avenue and Genesee Street, according to court documents. A civilian intervened, pointing a firearm at Baker and giving him a verbal command to drop his gun.
Baker complied, and officers subsequently recovered a loaded .380 caliber pistol from the ground next to where he was standing. A loaded 12 gauge shotgun was also recovered from a vehicle.
Baker was previously convicted of Attempted Criminal Possession of a Weapon in the 2nd degree in Erie County Court and is legally prohibited from possessing a firearm.
U.S. District Judge Richard J. Arcara sentenced Baker to 27 months in prison. The investigation was led by the Buffalo Police Department, under the direction of Commissioner Byron Lockwood, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives, under the direction of Special Agent-in-Charge John B. Devito, New York Field Division.
