EAST LIVERPOOL, OH – A quiet Tuesday afternoon in May 2014 turned into a scene ripped from a bad movie when the Home Savings and Loan Company on East Liverpool’s main drag was hit by a brazen robber. Now, nearly a decade later, federal authorities say they’ve finally caught up with the man they believe pulled the trigger – or rather, passed the note.
Brian Keith Johnston, 41, of Calcutta, Ohio, was formally indicted this week on a single count of bank robbery, according to a statement released by United States Attorney Steven M. Dettelbach for the Northern District of Ohio. The indictment alleges that on or about May 29, 2014, Johnston walked into the bank and made off with approximately $1,756.
While the amount stolen might seem paltry to seasoned bank robbers, the act itself carries a hefty potential penalty. If convicted, Johnston’s fate will be in the hands of the judge, who will consider his criminal history (if any), his specific role in the heist, and the details of the crime. But authorities are quick to point out that even the maximum sentence is not guaranteed, and most defendants receive less than the statutory limit.
The investigation into the robbery was a collaborative effort, involving the sharp eyes and dogged work of the Federal Bureau of Investigation, the East Liverpool Police Department, and the St. Clair Township Police Department. Assistant United States Attorney David M. Toepfer is handling the prosecution, tasked with building a case strong enough to secure a conviction.
But Johnston isn’t convicted yet. As the Department of Justice is careful to remind us, an indictment is merely an accusation. He’s presumed innocent until proven guilty beyond a reasonable doubt in a court of law. Johnston is entitled to a full and fair trial, where the government bears the burden of proving his involvement in the East Liverpool bank robbery.
Grimy Times will continue to follow this case as it unfolds, bringing you the unvarnished truth from the courtroom and beyond. The question now is: can the feds build a case that sticks, or will Johnston walk free? Stay tuned.
