A 35-year-old Roswell man has been sentenced to prison for violating federal firearms laws. Carlos Franco was sentenced to 27 months in prison followed by three years of supervised release for being a felon in possession of a firearm and ammunition.
According to court documents, Franco was arrested on February 26, 2014, on an indictment charging him with being a felon in possession of a firearm and ammunition. At the time, Franco was prohibited from possessing firearms or ammunition because he previously had been convicted of second degree murder and aggravated battery with a deadly weapon.
On June 5, 2013, in Chaves County, New Mexico, Franco possessed a pistol and multiple rounds of ammunition. He admitted to possessing these items when he pled guilty to the indictment on September 2, 2014. This admission led to his sentencing.
The case was investigated by the Las Cruces office of the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Chaves County Sheriff’s Office. Assistant U.S. Attorney Luis A. Martinez of the U.S. Attorney’s Las Cruces Branch Office prosecuted this case.
