Perjury Lands Eagle Butte Man Behind Bars
U.S. Attorney Ron Parsons announced that Charlie Marshall, a 27-year-old man from Eagle Butte, South Dakota, was sentenced on January 24, 2018, for perjury in federal court.
Marshall was ordered to serve 12 months in custody and pay a special assessment of $100 to the Federal Crime Victims Fund. The custody sentence will run concurrently with the sentences imposed in Marshall’s controlled substances and firearms case.
The case against Marshall began on May 16, 2017, when a federal grand jury indicted him for perjury and false declaration before a court. Marshall pleaded guilty to perjury on August 11, 2017.
On March 13, 2017, Marshall appeared before U.S. District Judge Roberto A. Lange to plead guilty to conspiracy to distribute a controlled substance, methamphetamine, and firearms charges. However, during the change of plea hearing, Marshall was found to be under the influence of alcohol and was administered a preliminary breath test, which registered a reading of 0.149.
A second change of plea hearing was held on March 21, 2017, due to Marshall’s intoxication during the initial hearing.
The case was investigated by the Federal Bureau of Investigation, with Assistant U.S. Attorney SaraBeth Donovan prosecuting the case. Marshall was immediately turned over to the custody of the U.S. Marshals Service after the sentencing hearing.
The perjury charges against Marshall stem from his agreement to answer questions truthfully during his guilty plea hearing, which he failed to do. Marshall’s actions have resulted in a 12-month prison sentence and a $100 special assessment, a serious consequence for his deceitful behavior.
