Niagara Falls, NY – Chiran Kantipuly, owner of Kanti Technologies, a New York-based environmental engineering and laboratory service company, was sentenced to 18 months in federal prison for a complex scheme involving falsified environmental testing data and tax evasion. The case, investigated by the Environmental Protection Agency (EPA) and the Internal Revenue Service (IRS), revealed a deliberate effort to cut corners on hazardous waste disposal, endangering public health and defrauding both the government and a major utility company.

According to court documents, Kantipuly conspired with former Niagara Mohawk Power Corporation (NIMO) Environmental Division Supervisor, Robert Grabowski, to provide fraudulent analytical results regarding the composition of soil, oil, and other environmental samples. NIMO relied on these falsified reports to determine proper waste disposal procedures. Instead of adhering to regulations for hazardous materials, NIMO unknowingly disposed of waste based on the inaccurate data provided by Kanti Technologies. Kantipuly then illegally dumped the hazardous waste on the grounds behind his company’s facility, bypassing environmental safeguards and potentially contaminating the surrounding area.

The investigation, initiated in 2005, led to indictments against both Kantipuly and Grabowski. Kantipuly was initially charged with one count of mail fraud (18 U.S.C. 1341) and two counts of violating IRS codes related to filing false tax returns (26 U.S.C. 7202(1)). Grabowski faced a single count of conspiracy (18 U.S.C. 371) for his role in the scheme. Grabowski ultimately pled guilty to the conspiracy charge, admitting his involvement in facilitating the fraudulent data exchange.

In April 2007, Kantipuly pled guilty to the two IRS violations, effectively admitting to years of tax evasion. The mail fraud charge was subsequently dismissed as part of the plea agreement. The sentencing, handed down in August 2007, included an 18-month prison sentence, a 12-month probationary period following release, a $200 special assessment fee, and an order to pay $33,494 in restitution to the IRS for the unpaid taxes. Grabowski received a 24-month probationary sentence and was ordered to pay $50,000 in restitution to NIMO to cover costs associated with the improper waste disposal.
