ALBUQUERQUE – Kai Begay, a 42-year-old man from Durango, Colo., was handed down a sentence of time served on Thursday for his federal child abuse conviction. Begay, who has been incarcerated for 216 days, is now subject to a year of supervised release and must pay $256.11 in medical restitution to the victim.
The nightmare began on Aug. 7, 2014, when Begay was reported by a Navajo Indian juvenile (the victim) who alleged he had been assaulting his mother at a residence on the Navajo Nation Indian Reservation in San Juan County, N.M. The initial police response failed to find anyone at the scene, but upon receiving a second call early on Aug. 8, officers discovered Begay had struck the child with an axe, fracturing the arm.
Begay entered a guilty plea on Dec. 15, 2014, admitting to putting the child in peril and causing serious bodily injury. He was subsequently indicted for abuse of a child resulting in serious bodily injury.
This harrowing case was meticulously investigated by the Shiprock office of the Navajo Nation Division of Public Safety and the Farmington office of the FBI. Assistant U.S. Attorney Kyle T. Nayback prosecuted the case, which has served as a chilling reminder of the dangers faced by children on reservations.
The community is relieved that justice has been served in this unsettling incident, with Begay’s sentencing marking the end of a dark chapter for those involved.
