Pueblo, Colorado – 2015
A Pueblo man has been sentenced to 28 months in federal prison for his role in the theft of firearms from RJC Firearms in Pueblo, Colorado.
Damion Shata Morgan, 23, pleaded guilty to conspiracy to commit theft of a firearm from a Federal Firearms Licensee (FFL)
Morgan was one of three defendants involved in the theft, which occurred on the evening of September 20, 2015. According to court records, Morgan was paid with heroin for his part in the conspiracy.
The other two defendants, Benjamin Miguel Acosta and David Anthony Lizarraga, were sentenced to 60 months and 64 months in federal prison, respectively, for their roles in the theft.
“Stealing guns from gun stores is a very serious threat to the safety of Colorado communities,” said Acting U.S. Attorney Bob Troyer. “Do that, and we will make sure you spend a good piece of your life in federal prison.”
The ATF and the Pueblo Police Department investigated the case, which was prosecuted by Assistant U.S. Attorney Kurt Bohn.
The surge in gun store burglaries is a concerning trend, according to ATF Acting Special Agent in Charge Ron Humphries. “These stolen guns end up at future crime scenes, including murders, and pose a risk to innocent civilians and law enforcement alike,” Humphries said.
The defendants were caught after a search warrant was obtained for Lizarraga’s residence, where officers found bolt cutters, a sledge hammer, and two sawed-off shotguns.
