A federal judge has convicted a North Carolina man of tax evasion, a crime that carries a maximum penalty of five years in prison.
Darren Lee Joy, 63, of Matthews, admitted to evading his 2015 individual income taxes by submitting to his employer an IRS Form W-4 falsely stating he was exempt from federal income tax withholding.
In addition to the false tax withholding form, Joy also failed to file a 2015 tax return, despite earning enough income to be required to do so.
The case is being investigated by the IRS-Criminal Investigation.
A federal district court judge will determine Joy’s sentence after considering the U.S. Sentencing Guidelines and other statutory factors.
Joy faces a period of supervised release, restitution, and monetary penalties as part of his sentence.
Acting Deputy Assistant Attorney General Stuart M. Goldberg of the Tax Division and U.S. Attorney Dena J. King for the Western District of North Carolina announced the guilty plea.
Trial Attorney Brian Flanagan of the Tax Division and Assistant U.S. Attorney Caryn Finley of the Western District of North Carolina are prosecuting the case.
The exact date of Joy’s sentencing has not been determined.
