Tax Fraud Rocks North Tonawanda
A North Tonawanda business owner has been sentenced to 30 months in prison for tax evasion, according to the U.S. Attorney’s Office in Buffalo.
David B. Schmitt, 65, was convicted of willfully attempting to evade and defeat the payment of federal employment taxes owed by his delivery businesses, Three Kids Trucking Inc. and 1553 Harlem Road Inc.
Between February 2010 and June 2013, Schmitt filed false forms with the IRS, had nominees open bank accounts to conduct business for the corporation, and created a fraudulent trust for one of the corporations.
The total loss to the IRS exceeded $500,000.
The sentencing is the result of an investigation by the Internal Revenue Service, Criminal Investigation Division, under the direction of Kathy A. Enstrom, Acting Special Agent-in-Charge.
Assistant U.S. Attorney Michael DiGiacomo, who handled the case, stated that the defendant’s actions were a serious breach of trust and a significant loss to the IRS.
Schmitt was also ordered to pay restitution totaling $748,459.75.
The case serves as a reminder of the importance of paying taxes and the consequences of tax evasion.
