David D’Aries, Mail Fraud, New Jersey 2013

David D’Aries, 49, of Summit, New Jersey, has been charged with defrauding hundreds of eBay sellers out of $122,000 in a scheme that spanned from June 2007 to October 2012.

According to a complaint filed in federal court, D’Aries posed as a buyer interested in purchasing rare and antique foreign banknotes on eBay. He made payment for the auctioned item via PayPal or credit card and then falsely claimed to various credit card companies that the item was never received from the seller or was an unauthorized charge.

D’Aries is accused of using three different identities, including his deceased father, in his fraudulent eBay transactions. A search of his home by law enforcement in June 2011 revealed thousands of foreign banknotes and 165 pieces of mail from around the world.

D’Aries faces a maximum potential penalty of 20 years in prison and a $250,000 fine.

The investigation was led by inspectors of the U.S. Postal Inspection Service, and the government is represented by Assistant U.S. Attorney Danielle Alfonzo Walsman.

The charges and allegations contained in the complaint are merely accusations, and D’Aries is presumed innocent unless and until proven guilty.

Defense counsel for D’Aries is Alan Zegas, Esq., of Chatham, New Jersey.
