Sex Offender Sentenced to 25 Months in Federal Prison for Failing to Register
Pierre, South Dakota – In a federal court case, U.S. District Judge Eric C. Schulte has sentenced David George Flute, III, to 25 months in federal prison for failure to register as a sex offender. The sentencing took place on January 20, 2026.
David George Flute, III, 36, has a history of failing to register as a sex offender. Flute was previously convicted of Aggravated Sexual Abuse of a Child and is required to register as a sex offender. He has seven prior convictions for Failure to Register as a Sex Offender and is well-aware of his obligation to register and to keep his registration current.
Flute was arrested by United States Marshals in Sioux Falls on May 21, 2025, after deciding to abscond from probation following his release from federal prison on November 11, 2024. He was indicted for Failure to Register as a Sex Offender by a federal grand jury in June 2025 and pleaded guilty on October 20, 2025.
As part of his sentence, Flute was ordered to pay a $100 special assessment to the Federal Crime Victims Fund. He will also serve five years of supervised release following his federal prison sentence.
The case was investigated by the U.S. Marshals Service and prosecuted by Assistant U.S. Attorney Carl Thunem. This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse.
David George Flute, III, is currently in the custody of the U.S. Marshals Service, serving his federal sentence. This case serves as a reminder of the importance of sex offender registration and the consequences of failing to comply with these laws.
