Delano White Eagle, 46, of Eagle Butte, South Dakota, is behind bars facing serious charges of assault. According to sources, White Eagle allegedly used a knife to assault his intimate partner, causing substantial bodily injury. The shocking incident took place near Dupree, South Dakota, on August 24, 2016.
The indictment, returned on September 20, 2016, charges White Eagle with Assault with a Dangerous Weapon, Assault by Strangulation and Suffocation, and Assault Resulting in Substantial Bodily Injury to an Intimate Partner. These charges carry a maximum penalty of up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
White Eagle appeared before U.S. Magistrate Judge Mark Moreno on September 22, 2016, and pled not guilty to the Indictment. The court has remanded him to the custody of the U.S. Marshals Service pending trial. A trial date has not been set.
Assistant U.S. Attorney Jay Miller is prosecuting the case, and the investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services.
The charges against White Eagle are merely an accusation, and he is presumed innocent until proven guilty in a court of law.
