BILLINGS, MT – A desperate run from Billings police ended with a 16-month federal prison sentence for Devin Miranda American Horse, 34, after he was caught with a rifle despite being a convicted felon. The sentencing, handed down by U.S. District Judge Susan P. Watters, also includes three years of supervised release following his incarceration.
The case unfolded in February 2023 when a Billings police officer spotted a car occupied by several individuals. Before contact could be made, the driver bolted, sparking a brief chase. American Horse, identified as a front-seat passenger, joined the flight, ditching the vehicle and attempting to disappear into nearby bushes. Officers quickly apprehended him and discovered a rifle stashed close by.
American Horse’s history played a crucial role in the charges. He was already on parole for a 2019 felony drug conviction in Yellowstone County, a conviction that legally barred him from possessing any firearms. The discovery of the rifle, combined with his prior record, led to the charge of prohibited person in possession of a firearm, to which he pleaded guilty in August 2023.
The investigation was a joint effort between the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Billings Police Department. Assistant U.S. Attorney Lori Harper Suek led the prosecution, building a case centered on the clear violation of federal gun laws and American Horse’s documented criminal history. The owner of the vehicle, who became the driver after American Horse fled, cooperated with police.
Federal officials are framing the prosecution as part of Project Safe Neighborhoods (PSN), a broad initiative designed to reduce violent crime and gun violence across the nation. The program emphasizes collaboration between law enforcement at all levels and community involvement, aiming to address the root causes of crime and bolster public safety. The Department of Justice launched a strengthened PSN strategy in May 2021.
While the 16-month sentence may seem relatively short, federal prosecutors are sending a message: convicted felons caught with firearms will face consequences. The ATF’s Denver Field Division continues to aggressively pursue cases involving illegal gun possession, aiming to keep weapons out of the hands of those legally prohibited from owning them. American Horse will now have ample time to reflect on his choices behind bars.
