Dhanzasikam R. Toledo, Voluntary Manslaughter, New Mexico 2012

A Ramah Navajo man has been sentenced to prison for his role in a deadly stabbing incident on the Navajo Indian Reservation.

Dhanzasikam R. Toledo, 21, was sentenced to 72 months in prison followed by three years of supervised release for his voluntary manslaughter conviction.

The crime took place on November 10, 2011, in Ramah, New Mexico, where Toledo stabbed his uncle to death during an argument over a debt.

According to the evidence presented at trial, the argument escalated into a physical confrontation, with Toledo stabbing the victim after the victim made racially derogatory slurs about Toledo, who is of Indian and African-American descent.

Toledo was arrested on November 21, 2011, on a criminal complaint alleging murder, and was later indicted on a second-degree murder charge on December 13, 2011.

A federal jury acquitted Toledo of the second-degree murder charge on September 26, 2012, but convicted him of the lesser included charge of voluntary manslaughter.

The case was investigated by the Gallup office of the FBI and the Ramah Navajo Nation Police Department, and was prosecuted by Assistant U.S. Attorneys Niki Tapia-Brito and Presiliano Torrez.
