Physician Agrees to Pay $124,110 to Settle Medicare Fraud Case

A local physician has agreed to pay $124,110 to settle allegations that he submitted false claims to Medicare, according to a recent announcement by Acting United States Attorney Richard W. Murphy. Douglas J. Jorgensen, D.O, a physician from Manchester, Maine, has entered into a civil settlement agreement with the government.

The allegations against Dr. Jorgensen stem from a civil complaint filed on an unspecified date. According to the complaint, Dr. Jorgensen is alleged to have violated the federal False Claims Acts by submitting claims for certain evaluation and management (“E&M”) services that were not eligible for payment under Medicare. Dr. Jorgensen submitted these claims knowing, deliberately ignoring or recklessly disregarding that they were false.

The investigation revealed that Dr. Jorgensen was not entitled to be paid for the E&M services because they were provided in connection with, and integral to, osteopathic manipulative treatment Dr. Jorgensen performed on the same day. In total, Dr. Jorgensen received $62,055 from the Medicare Trust Fund to which he was not entitled.

The settlement amount represents twice the amount of damages incurred by the Medicare program. The U.S. Department of Health & Human Services, Office of Inspector General, investigated the case.
