Albuquerque, New Mexico – In a shocking turn of events, Duane Day, a 31-year-old resident of New Laguna, New Mexico, has been sentenced to three years in federal prison for assault with a dangerous weapon resulting in serious bodily harm in Indian Country.
The crime took place on March 24, 2020, at Day’s father’s home on the Laguna Pueblo, where he became enraged that he couldn’t access the internet. In a fit of anger, Day assaulted his 18-year-old niece, punching, shoving, and strangling her twice. On the second occurrence, the victim lost consciousness after being strangled for an extended period.
When the victim regained consciousness, Day threatened her with a metal hoe. The victim was later transported to the University of New Mexico Hospital Emergency Room for treatment.
This is not Day’s first brush with the law. In 2015, he pleaded guilty to assault by strangulation and attempted manslaughter and was sentenced to four years in prison followed by three years of supervised release. The 2014 incident involved Day placing his knee on the victim’s neck and covering her mouth with his hand, causing her to suffocate.
Despite his history of violence, Day managed to get out of prison and was released. However, his freedom was short-lived, as he was arrested and charged with assault with a dangerous weapon in Indian Country.
The investigation into the case was conducted by the Violent Crime and Gang Squad of the FBI Albuquerque Field Office, in collaboration with the Bureau of Indian Affairs and the Laguna Police Department. Assistant U.S. Attorney Alexander F. Flores prosecuted the case.
Day, who is an enrolled member of the Pueblo of Laguna, will serve three years in prison and three years of supervised release upon his release. His actions have sent shockwaves through the community, highlighting the need for greater awareness about domestic violence and the consequences of such behavior.
