Duane Kidder, Assault with a Dangerous Weapon, North Dakota 2013

BISMARCK – A Fort Yates man has pleaded guilty to two counts of assault with a dangerous weapon, according to the U.S. Attorney’s Office.

On January 16, 2012, Duane Kidder assisted co-defendant, Lionel Jewett, in assaulting a woman in Fort Yates. Jewett used a garden hoe and a fence post pounder to inflict injuries on the woman, which required medical treatment but were not life-threatening.

Kidder also assaulted a woman on January 30, 2013, by kicking her in the face with his foot while he was wearing shoes. The injury to the woman required medical treatment.

Each count of assault with a dangerous weapon carries a statutory maximum penalty of 10 years in federal prison and a $250,000 fine.

The case was investigated by the Federal Bureau of Investigation and the Bureau of Indian Affairs – Standing Rock Agency.

Kidder’s sentencing has been scheduled for July 19, 2013, in U.S. District Court in Bismarck, North Dakota.

Assistant U.S. Attorney Gary Delorme is prosecuting the case.

The U.S. Attorney’s Office did not provide further information on the status of co-defendant Lionel Jewett, who pleaded guilty on August 20, 2012. Jewett’s sentencing has been scheduled for April 29, 2013, in U.S. District Court in Bismarck, North Dakota.
