William Vandervier, First Degree Burglary and Simple Assault, South Dakota 2011

A disturbing crime has shaken the small town of Dupree, South Dakota. William Vandervier, a 26-year-old local resident, has pleaded guilty to First Degree Burglary and Simple Assault in a federal court.

According to court documents, Vandervier unlawfully entered an occupied structure at night and assaulted an adult female victim with whom he had a previous relationship in November of 2011. The victim was left shaken and disturbed by the violent attack.

The maximum penalty for First Degree Burglary is 25 years of custody, a $250,000 fine, or both; up to 5 years of supervised release; a $100 special assessment; and the Court could order restitution to the victim. The maximum penalty for Simple Assault is 6 months of custody and a $5,000 fine, or both; and a $10 special assessment.

U.S. Attorney Brendan V. Johnson announced Vandervier’s guilty plea, stating that the case was a result of an investigation conducted by the Cheyenne River Sioux Tribe Law Enforcement Division. Assistant U.S. Attorney Mikal Hanson is leading the prosecution of the case.

A presentence investigation has been ordered, and Vandervier was remanded to the custody of the U.S. Marshals Service pending sentencing. A court date has been set for August 5, 2013.
