DUPREE, SD – Miles Condon, a 25-year-old resident of Eagle Butte, South Dakota, will spend the next three years in federal custody after being sentenced for a particularly brutal assault and subsequent resistance of law enforcement. U.S. District Judge Roberto A. Lange handed down the sentence on March 8, 2017, following Condon’s guilty plea in December 2016. The United States Attorney’s Office, led by Randolph J. Seiler, secured the conviction.
The initial incident occurred August 3, 2016, in Dupree, SD. According to court documents, Condon, after consuming alcohol, lured a victim to his residence under the pretense of asking for money. A verbal dispute quickly escalated. When the victim uttered a derogatory remark, Condon allegedly grabbed a golf club already positioned outside and swung it with force, striking the man above the left ear. The blow inflicted a severe 2½” long and ½” wide gash to the victim’s skull. Despite the attack, the victim managed to grab the club, causing Condon to fall, before fleeing to seek medical attention. He was transported to the Indian Health Service Hospital and then to Rapid City Regional Hospital with a skull fracture.
Condon’s troubles didn’t end with the assault. When law enforcement – officers from the Cheyenne River Sioux Tribe and the Ziebach County Sheriff’s Office – arrived on October 13, 2016, to execute a federal arrest warrant, they found Condon asleep on the floor of his home. Upon being roused and advised of his arrest, Condon immediately became combative. Officers reported he explicitly stated his intention to “act up,” and subsequently resisted being moved towards the patrol car, requiring them to physically drag him. The resistance continued as officers attempted to secure him, culminating in Condon repeatedly slamming his head against the trunk of the vehicle.
The struggle didn’t abate upon arrival at the Cheyenne River Adult Detention Facility. Condon remained belligerent and uncooperative during booking. He refused to cooperate with a search, requiring officers to physically restrain him. The situation escalated further when, after one leg restraint was removed, Condon kicked a detention officer in the face, knocking off his glasses. Only after additional restraints were applied and officers retreated from the holding cell was the immediate threat contained.
Condon was sentenced to 36 months of custody on both charges – Assault Resulting in Serious Bodily Injury and Assaulting, Resisting, and Impeding a Federal Officer – to be served concurrently. Following his prison term, he will face three years of supervised release and must pay a $200 assessment to the Federal Crime Victims Fund. The case was investigated by the Cheyenne River Sioux Tribe Law Enforcement Services and the Ziebach County Sheriff’s Office, and prosecuted by Assistant U.S. Attorney Jay Miller. The victim’s condition following the attack remains undisclosed.
