Elias Gallegos, Assault with a Knife and a Rock, New Mexico 2021

Albuquerque man Elias Gallegos, 27, is headed to federal prison for more than four years after a jury convicted him of assaulting a U.S. Postal Service letter carrier with a knife and a rock in a violent September 2021 encounter.

On September 17, 2021, Gallegos confronted the mail carrier as the worker made deliveries on foot near Constitution Avenue NE and Monroe Street NE. According to court records, Gallegos brandished a pocketknife, chased the employee down the street, and hurled a rock at him—missing but escalating the terror of the attack.

The letter carrier fled to his mail truck and dialed 911. When Albuquerque Police arrived, Gallegos bolted on foot, leaping over multiple backyard fences in a desperate escape attempt. Officers tracked him to a shed behind a residence on Manzano Street, where he was caught trying to access the home’s back door.

A search of the shed uncovered the pocketknife used in the assault and a torch lighter. The weapons were later presented as evidence in court. Gallegos was charged federally due to the victim’s status as a federal employee.

“The men and women of the U.S. Postal Service brave our streets daily in service of the public,” said U.S. Attorney Alexander M.M. Uballez. “When those streets level senseless threats, the United States will protect the federal employees who serve our nation and hold accountable those who plague our community with violence.”

Melisa Llosa, Inspector in Charge of the U.S. Postal Inspection Service’s Phoenix Division, reaffirmed the agency’s resolve: “Today’s sentencing of Elias Gallegos shows the determination of the U.S. Postal Inspection Service, along with their law enforcement partners, to vigorously pursue and bring criminals to justice who attempt to commit crimes or harm any postal employee.” Gallegos will serve three years of supervised release upon his prison term. The case was investigated by the U.S. Postal Inspection Service and Albuquerque Police Department and prosecuted by Assistant U.S. Attorneys Samuel A. Hurtado and Patrick Cordova.
