Eloy Infante, Elpidio Yanez Jr., Adrian Guerrero, Bribery and Attempted Extortion, Texas 2015

Two Donna, Texas, School Board members and a private citizen are facing serious charges after allegedly attempting to extort and solicit bribes from a businessman in exchange for a services contract with the Donna Independent School District (DISD).

The U.S. District Court for the Southern District of Texas unsealed an indictment on October 27, 2015, charging Eloy Infante, Elpidio Yanez Jr., and Adrian Guerrero with conspiracy, attempted extortion, and federal programs bribery.

According to the indictment, from February 2015 through May 2015, the defendants allegedly informed the businessman that his company needed to pay Infante and Yanez $10,000 each in order to keep its contract with the DISD. The indictment alleges that both Infante and Yanez accepted partial payment of the $10,000, with Guerrero serving as the middleman for one of the payments.

Eloy Infante, 53, and Elpidio Yanez Jr., 45, both of Donna, Texas, are members of the Donna School Board, while Adrian Guerrero, 50, is a private citizen from Donna. The indictment charges them with one count of conspiracy, one count of attempted extortion, and two counts of federal programs bribery.

The case was investigated by the FBI, with assistance from the trial attorneys in the Criminal Division’s Public Integrity Section and the U.S. Attorney’s Office for the Southern District of Texas.

The defendants are presumed innocent unless and until proven guilty. The outcome of their case is currently pending.
