Elvy Gomez, Embezzlement, Rhode Island 2013

PROVIDENCE, R.I. – In a shocking case of financial deceit, a former Bank of America employee has been sentenced to 12 months and 1 day in community confinement for embezzling over $95,000 from stolen federal tax checks.

Elvy Gomez, 40, of Providence, R.I., pleaded guilty on June 12, 2013 to one count each of theft of government property, forging an endorsement on treasury checks, and money laundering.

According to court documents, Gomez used his position at the bank to access a dormant checking account, which he used to deposit stolen treasury checks and then withdraw the funds. He admitted to obtaining an ATM card in the name of the person whose name appeared on the account and depositing 14 stolen treasury checks totaling $95,559 into the bank account between April 2012 and August 2012.

U.S. District Court Chief Judge Mary M. Lisi sentenced Gomez to 12 months and 1 day of community confinement, followed by 3 years supervised release. He was also ordered to forfeit $34,376.37 and pay $95,559 in restitution.

The case was prosecuted by Assistant U.S. Attorney John P. McAdams. The matter was investigated by IRS Criminal Investigation with the assistance of the U.S. Secret Service.

Gomez’s sentence serves as a warning to individuals who engage in white-collar crimes, and highlights the importance of accountability in the financial industry.

The case is a reminder that embezzlement is a serious crime with severe consequences, and that those who engage in such activities will be held accountable.
