Eric Eugene Hartwell, a 52-year-old Denver resident, has been found guilty of escape and failure to register as a sex offender in a case that spanned over two years.
The U.S. Attorney’s Office and the U.S. Marshal’s Service announced that Hartwell was found guilty following a four-day jury trial before U.S. District Court Judge Philip A. Brimmer.
The jury deliberated for approximately over two hours before reaching their verdicts. Hartwell, who was in custody during the trial, was remanded after the jury reached their verdicts.
Hartwell faces not more than 5 years in prison, and up to a $250,000 fine for escape, and not more than 10 years in prison and up to a $250,000 fine for failure to register as a sex offender.
According to the prosecution, Hartwell was convicted on March 19, 2010, in U.S. District Court for the Northern District of Texas for failure to register as a sex offender. He was sentenced to a 60-month term of imprisonment and ordered to serve a lifetime of supervised release.
After serving his federal prison sentence, Hartwell was transferred to Colorado to begin his term of supervised release and to begin a term of parole in conjunction with his Colorado Failure to Cancel Registration conviction.
The U.S. Marshal’s investigation revealed that Hartwell withdrew $3,600 from an ATM in Denver and removed and discarded a GPS-tracking ankle monitor that he was required to wear as a condition of his Colorado state-parole.
Hartwell was arrested on February 28, 2014, after he was located by the U.S. Marshals in a motel in Norfolk, Virginia, after traveling on the Greyhound Bus Line under the name ‘John Miller’.
Hartwell is scheduled to be sentenced on November 20, 2015, before Judge Brimmer.
