A Smethport man has been charged with impersonating a US Marshal in a 2021 traffic accident.
According to authorities, Ernest Lathrop, Sr., 59, activated emergency lights on his vehicle at the scene of a traffic accident and falsely stated to others that he was a US Marshal.
The incident occurred on January 31, 2021. If convicted, Lathrop faces up to 3 years in prison, a fine of $250,000, or both.
The law provides for a maximum total sentence of 3 years in prison, a fine of $250,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed would be based upon the seriousness of the offense and the prior criminal history, if any, of the defendant.
The case is being prosecuted by Assistant United States Attorney Christian A. Trabold on behalf of the government. The United States Marshal’s Service and the Federal Bureau of Investigation (FBI) conducted the investigation leading to the indictment in this case.
An indictment is an accusation. A defendant is presumed innocent unless and until proven guilty. Lathrop has yet to enter a plea in the case.
Ernest Lathrop, Sr. is the sole defendant named in the one-count indictment. He is facing charges of false impersonation of officer or employee of the United States.
