Utah Companies Banned from Producing and Distributing Adulterated and Misbranded Dietary Supplements

Two Utah-based companies, Evig LLC and Premium Productions LLC, and their executives have been banned from producing and distributing adulterated and misbranded dietary supplements.

The U.S. Food and Drug Administration (FDA) had previously sent both companies warning letters in August 2019 after inspections showed the defendants had no system in place to handle customer complaints, despite receiving reports asserting that their products may have caused allergic reactions from ingredients not identified on the label.

In a complaint filed on Oct. 11 in the U.S. District Court for the District of Utah, the United States alleged that Evig LLC and its CEO, David Lex Howard, violated the federal Food, Drug and Cosmetic Act (FDCA) by distributing adulterated and misbranded dietary supplements.

The complaint further alleges that the dietary supplements involved are marketed throughout the United States under the brand name Balance of Nature and that they were neither approved by FDA nor exempt from approval, making them unapproved new drugs and misbranded under the terms of the FDCA.

Additionally, the complaint alleges that the defendants claimed their dietary supplements can cure, treat and prevent a variety of diseases and health conditions, including cancer, heart disease, diabetes and coronavirus.

The defendants agreed to settle the suits and be bound by consent decrees of permanent injunction. The orders entered by the court permanently enjoin the defendants from violating the FDCA and require manufacturing process improvements.
