Michael Harston, Conspiracy to Accept Bribes, Kansas 2023

Michael Harston, 53, of Kansas City, Mo., is done playing both sides. The former U.S. Penitentiary guard at Leavenworth was sentenced Monday to two years of probation and six months of home confinement after admitting he took bribes to smuggle contraband tobacco to inmates. Harston also must pay $4,800 in fines for crimes committed behind federal prison walls.

Harston pleaded guilty to one count of conspiracy to accept bribes and one count of accepting bribes. Inside the high-security facility, he used his badge to run a side hustle—delivering six-ounce cans of Bugler loose tobacco for as much as $1,000 a pop. The tobacco, strictly banned inside USP Leavenworth, became a black-market currency, trafficked with the help of inmates’ families and friends on the outside.

The scheme was simple but dangerous: loved ones on the outside paid Harston, who then brought the contraband into the prison during his shifts. Inmates received the tobacco, and Harston pocketed the cash. Over time, the operation became bolder, exploiting trust and security gaps in one of the country’s most notorious federal lockups.

Acting U.S. Attorney Tom Beall didn’t mince words. “This wasn’t just a breach of protocol—it was a betrayal of the public’s trust,” Beall said. “Guards are there to enforce the law, not break it for profit.” Harston’s actions, Beall stressed, undermined facility safety and integrity.

The case was cracked open by a joint investigation involving the FBI, the Justice Department’s Office of Inspector General, and the USP Leavenworth Special Investigation Service. Assistant U.S. Attorney Leena Ramana prosecuted, securing a conviction that, while avoiding prison time, brands Harston a convicted felon.

Harston’s fall from trusted corrections officer to convicted bribe-taker is a grim reminder: even behind bars, corruption can thrive. His name now joins a long line of public servants who traded their integrity for cash—only to find the price was far higher than they ever counted.
