CLARKSBURG, WEST VIRGINIA – Another West Virginia felon is off the streets after a thirty-month federal sentence was handed down today to Russell Lee Kirk, 43, of Fairmont. Kirk pleaded guilty and was convicted of unlawful firearm possession, a charge that carries significant penalties given his already checkered past.
The bust went down during a routine traffic stop where officers spotted a firearm brazenly strapped to the steering column of Kirk’s vehicle. It wasn’t a hunting rifle or a collector’s item – it was a clear violation of federal law, considering Kirk’s history. Court documents confirm the man was already prohibited from owning any firearms due to previous convictions for malicious assault and prior firearms offenses. This wasn’t his first dance with the law, and clearly, he hadn’t learned his lesson.
Federal prosecutors weren’t letting this slide. Assistant U.S. Attorney Andrew Cogar skillfully presented the case, laying out the evidence and securing the thirty-month sentence. The government made it clear that repeat offenders like Kirk pose a danger to the public and will be dealt with harshly.
The investigation was a joint effort between the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the West Virginia State Police. These agencies worked diligently to build a solid case against Kirk, proving beyond a doubt that he knowingly violated federal firearms laws. Their collaborative work is a testament to the ongoing fight against gun violence in the state.
Chief U.S. District Judge Thomas S. Kleeh presided over the case and delivered the sentence, sending a strong message that possessing firearms while legally prohibited will not be tolerated. Thirty months might not seem like a long time to some, but it’s a significant penalty that hopefully will deter Kirk – and others – from making similar mistakes in the future.
Kirk will now begin serving his sentence, trading the open roads of West Virginia for a federal prison cell.
