Fake Agent Busted: Pham Nguyen Faces Federal Charges

SANTA ANA, CA – Donovan Pham Nguyen, 34, of Riverside, is in federal custody after being charged with one count of false impersonation of a federal officer or employee. The arrest, announced today, caps a years-long scheme where Nguyen allegedly fabricated his identity as a Homeland Security Investigations (HSI) special agent, exploiting the ruse for personal benefit.

According to court documents, Nguyen’s deception stretches back years. He previously worked as a privately contracted security guard at a Department of Homeland Security (DHS) facility, but was subjected to an internal investigation in 2015 after being caught allegedly printing counterfeit HSI identification. He didn’t let that stop him. The affidavit details how Nguyen continued to maintain the false persona, even while employed as a private security guard at an Orange County retirement community.

The brazenness of Nguyen’s alleged actions is staggering. In May 2019, he reportedly used his fabricated title to influence agents from the U.S. Department of State’s Diplomatic Security Service while they were executing an arrest warrant. Two years later, in June 2020, he attempted to leverage his false credentials during a meeting with the Riverside County District Attorney’s Office, falsely claiming HSI couldn’t assist with an ongoing investigation after a mutual acquaintance introduced them. He then allegedly informed the DA’s office HSI could not help, a claim made under the guise of his fake position.

But the lies didn’t stop at bureaucratic maneuvering. Nguyen allegedly used a fake DHS ID to purchase firearms, allowing him to bypass mandatory California safety courses. He also reportedly used his purported “duties” as an HSI agent to explain frequent absences from his actual job. Coworkers at the security firm reported a disturbing display of paraphernalia: an HSI badge, a DHS plaque, tactical gear including a ballistic shield, and even red and blue emergency lights and a siren on his personal vehicle. Nguyen also allegedly handed out HSI-branded mugs and coins.

The extent of Nguyen’s fabricated life is laid bare in his online presence. His LinkedIn profile falsely stated he’d been a “Department of Homeland Security Agent” since 2008. He even appeared in a YouTube video presented as an interview with a long-time HSI special agent discussing immigration policies. The feds finally caught on, and Nguyen is now facing the consequences.

If convicted, Nguyen faces a statutory maximum sentence of three years in federal prison. The investigation was a joint effort by Homeland Security Investigations, U.S. Immigration and Customs Enforcement’s Office of Professional Responsibility, the Riverside County District Attorney’s Office, the U.S. Department of State’s Diplomatic Security Service, and the Orange Police Department. The case is being prosecuted by Assistant United States Attorneys John A. Balla and Jerry C. Yang of the Riverside Branch Office. Remember, a criminal complaint contains allegations, and Nguyen is presumed innocent until proven guilty beyond a reasonable doubt.
