Chance Brannon, 23, an active duty Marine based at Camp Pendleton; Tibet Ergul, 21, of Irvine; and Xavier Batten, 21, of Florida, are accused of conspiring to attack the facility with a Molotov cocktail. The indictment, unsealed this week, details a disturbing plot. Brannon and Ergul allegedly scouted the location, procured the materials—a glass bottle, accelerant, and a rag—and assembled the crude incendiary device. On March 13, 2022, they allegedly hurled the flaming cocktail at the clinic, causing damage and forcing a temporary closure. Approximately 30 appointments were canceled, denying women access to essential reproductive healthcare. Batten, the Florida resident, is accused of being a co-conspirator in the plot.
Federal prosecutors are hitting the trio with multiple charges, including conspiracy, malicious destruction of property by fire and explosion, and possession of an unregistered destructive device. The latter charge highlights the seriousness of constructing and deploying a homemade bomb, even a rudimentary one. They also face a misdemeanor charge under the Freedom of Access to Clinic Entrances Act, recognizing the specific targeting of a reproductive health facility. This isn’t just property damage; it’s an attempt to intimidate and obstruct access to legal medical care.
Brannon and Ergul are scheduled to be arraigned today. Batten, already in federal custody in Florida after his initial court appearance, is being held without bond pending trial.
