Fernando Agurto, a 40-year-old Buffalo man, has pleaded guilty to possession with intent to distribute cocaine and possession of a firearm in furtherance of drug trafficking activity, according to a recent plea agreement.
The charges carry a mandatory minimum of five years in prison, a maximum of life in prison, and a $1,000,000 fine.
On July 29, 2016, the Buffalo Police executed a search warrant at 68 Vanderbilt Street in Buffalo, recovering a .380 caliber pistol, brass knuckles, and a quantity of cocaine.
Officers also discovered $5,700 in cash hidden in the ceiling above the basement stairs.
The plea is the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, under the direction of Special Agent-in-Charge Ashan Benedict, New York Field Division.
Sentencing is scheduled for April 11, 2018, at 12:30 p.m. before Judge Richard J. Arcara.
Assistant U.S. Attorney Patricia Astorga is handling the case.
The investigation into Agurto’s activities is ongoing.
