Fernando Garcia-Guerrero, Illegally Re-entering the United States, Iowa 2022

A 35-year-old Mexican man was sentenced to prison for re-entering the United States after being deported. Fernando Garcia-Guerrero, residing in Williamsburg, Iowa, received a three-month prison term.

Garcia-Guerrero pleaded guilty on February 14, 2022, to one count of illegal reentry into the United States after having been deported. He admitted to previously being deported from the United States in March 2005 and re-entering by wading across the Rio Grande River near Hidalgo, Texas, in August 2005. He was arrested and deported again in August 2017 and September 2017, and was most recently deported in January 2022 after being arrested on state charges in Iowa.

Garcia-Guerrero was sentenced in Cedar Rapids by United States District Court Judge C.J. Williams. He must serve a one-year term of supervised release after completing his prison term. Garcia-Guerrero is currently being held in the United States Marshal’s custody until he can be turned over to immigration officials.

The case was prosecuted by Assistant United States Attorney Daniel C. Tvedt and investigated by the Department of Homeland Security, Immigration and Customs Enforcement, Enforcement and Removal Operations.

Garcia-Guerrero will spend the next three months behind bars before being released and starting his one-year supervised release. He will have to comply with the terms set by his probation officer during this time.
