Today, over $100,000 worth of baby formula – more than 7,000 bottles and cans – hit the shelves of the Food Bank of Central New York, a direct result of James’ takedown of price gougers who exploited the 2022 nationwide formula shortage. This isn’t charity; it’s restitution ripped from the hands of those who preyed on panicked parents.

The haul comes from a settlement with Marine Park Distribution, Inc. (Marine Park) and its affiliate, Formula Depot, Inc. (Formula Depot), busted by the Attorney General’s Office (OAG) for illegally inflating prices during a time of desperate need. The investigation revealed Marine Park brazenly doubled the price of a can of formula, jacking it up to $36 from a pre-shortage cost of $18. Formula Depot wasn’t far behind, squeezing its customers for every penny. One victim, reliant on the company for specialized formula for babies with allergies, saw a case of formula jump from $190 to $245 in mere weeks.

“No parent should have to struggle to buy formula for their baby because corporations are attempting to profit from a crisis,” Attorney General James stated bluntly. “Price gouging during an emergency is illegal, and my office will continue to go after any company that tries to take advantage of hardworking New Yorkers.” This isn’t just about formula; it’s about sending a message: exploit a crisis, and James will come for you. The OAG investigation found Marine Park and Formula Depot raised prices over 60 percent more than was allowed under the law, raking in hundreds of thousands of dollars in illicit profits.

The 2022 shortage, triggered by a plant closure and recall, left families scrambling. Three out of four infants in the U.S. rely on formula in their first six months, making the crisis a nightmare for parents. While families were rationing and desperately searching for supplies, Marine Park and Formula Depot saw an opportunity to line their pockets. James responded swiftly, issuing warnings to over 30 retailers across the state in May 2022 to halt the price hikes after a flood of consumer complaints.

The settlement with Marine Park and Formula Depot isn’t just about the $675,000 in donated formula. The companies are also barred from future price gouging and slapped with a $75,000 penalty. Today’s delivery to the Food Bank of Central New York, serving Cayuga, Chenango, Cortland, Herkimer, Jefferson, Lewis, Madison, Oneida, Onondaga, Oswego, and St. Lawrence counties, marks the final distribution of the settlement. James has already secured formula donations for families in Rochester, the Bronx, and the Capital Region. To date, the Attorney General has recovered over $800,000 in baby formula through these crackdowns.
