TUCSON, Ariz. – Manuel Victor Gastelum, 27, of Douglas, Arizona, is facing over a decade behind bars after a federal judge handed down a 130-month sentence for a human smuggling operation gone tragically wrong. Judge Rosemary Márquez didn’t mince words, emphasizing the need to protect the public from a repeat offender with a blatant disregard for human life.
The December 4, 2020 incident saw Gastelum picking up eight undocumented noncitizens near the border, cramming them into a vehicle for transport further into the U.S. The run quickly devolved into a high-speed disaster on Interstate 10 near Vail. Gastelum’s reckless driving led to a violent rollover crash. A 42-year-old male passenger was ejected and pronounced dead at the scene. Several others suffered serious injuries. Gastelum, rather than render aid, bolted from the wreckage, only to be apprehended miles away later that morning.
This wasn’t Gastelum’s first rodeo. In 2019, he was convicted of Transportation of Aliens for Profit Placing Life in Jeopardy after another ill-fated smuggling run. That time, he fled from law enforcement and crashed into a gas station while transporting undocumented individuals. He received an 18-month sentence and three years of supervised release – a slap on the wrist, it seems, considering his latest offense occurred just three months after being released from prison. The current sentencing also includes 12 months for violating the conditions of his previous federal probation.
The courtroom was reportedly somber as Judge Márquez delivered the sentence. The prosecution successfully argued that Gastelum’s actions demonstrated a pattern of prioritizing profit over the safety of those he transported, culminating in a preventable death. The victim’s family, while present, declined to make a statement, their grief palpable.
The investigation was conducted by Homeland Security Investigations, Tucson, with support from the Arizona Department of Public Safety. Assistant U.S. Attorneys from the District of Arizona, Tucson, secured the conviction. This case, bearing case numbers CR-21-00516-TUC-RM-MAA and CR-19-01602-TUC-RM-MAA, serves as a stark reminder of the dangers inherent in illegal border crossings and the callousness of those who exploit vulnerable individuals for financial gain.
Gastelum will now spend the next eleven years and two months in federal prison, followed by five years of supervised release. Whether this finally deters him from a life of crime remains to be seen.
