South Bend, Indiana – A 64-year-old man with a decades-long criminal record is headed to federal prison after being caught with a loaded handgun while driving illegally in the middle of the night. George Harvey, of South Bend, was sentenced to 51 months in federal prison by District Court Judge Jon E. DeGuilio, marking the latest chapter in a long history of brushes with the law.
Harvey pleaded guilty to being a convicted felon in possession of a firearm, a charge that carries severe penalties under federal law. At the time of his arrest, he was already awaiting sentencing in state court for another crime—yet still chose to carry a loaded weapon and drive without a valid license, according to court documents filed in the case.
Shortly after midnight, South Bend police pulled Harvey over for a routine traffic violation. What started as a simple stop quickly escalated when officers discovered a loaded handgun inside the vehicle. Also found in the car: a crack pipe, indicating active drug use. The discovery triggered a federal investigation led by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), with support from local police.
Harvey’s criminal history is extensive. Court records show he has 11 prior felony convictions and 20 misdemeanor convictions, spanning years of repeat offenses. Federal prosecutors argued that his repeated violations and continued possession of firearms posed a clear danger to the community. His criminal pattern, they said, warranted serious federal time.
Assistant United States Attorney Joel Gabrielse prosecuted the case, emphasizing that Harvey’s actions were not a one-time mistake but part of a broader pattern of lawlessness. “This is a man who has been told repeatedly that he cannot have a firearm. He ignored that. He carried one anyway—loaded—while driving illegally and using drugs,” Gabrielse stated in court.
Harvey will serve 51 months in federal prison followed by one year of supervised release. The sentence, handed down by Judge DeGuilio, underscores federal zero-tolerance policies for felons caught with firearms, especially those with violent or repeat histories. The ATF and South Bend Police Department continue to target illegal gun possession in high-crime areas across northern Indiana.
