NEW BERN, N.C. – Daniel Oliver-Perez, a 21-year-old man from Greenville, North Carolina, was sentenced to 2 years’ probation, 6 months of house arrest and 60 days intermittent confinement for assaulting two Immigration and Customs Enforcement (ICE) officers.
Oliver-Perez pleaded guilty to the charges on October 17, 2019, according to court documents and other information presented in court. The incident occurred when ICE officers were attempting to execute an administrative arrest warrant against Oliver-Perez’s father.
Oliver-Perez’s father, who was attempting to enter the United States in 2014 using a false claim of citizenship, was arrested by immigration officials and later convicted in the United States District Court for the Western District of Texas of attempted illegal entry by false representation.
After multiple stays of removal, Oliver-Perez’s father was directed to appear at the ICE office in Charlotte, North Carolina, with tickets to depart the United States before December 16, 2017. However, he failed to show up for his scheduled flight, becoming a fugitive and violating the conditions of his order of supervision.
On November 23, 2018, ICE officers were present at the Application Support Center (ASC) in Morrisville, North Carolina, to execute an arrest warrant against Oliver-Perez’s father. The officers were positioned in various areas of the building, and a supervisor observed Oliver-Perez’s father and Oliver-Perez entering the ASC at approximately 9:00 AM.
As Oliver-Perez’s father was standing in line, the ICE officer approached him and alerted the other officers. It was then that Oliver-Perez assaulted the ICE officers, resisting and impeding them from executing the arrest warrant.
Oliver-Perez’s actions were widely condemned, and he was subsequently charged and sentenced for his role in the altercation. The incident highlights the tensions between law enforcement and the immigrant community, and the importance of upholding the rule of law.
