Columbia, SC – Guadencio Morgado-Martinez, a 32-year-old native and citizen of Mexico, has been found guilty of re-entering the United States illegally.
A United States Attorney’s press release stated that Morgado-Martinez, of Myrtle Beach, SC, pled guilty in federal court in Florence, to Illegal Re-Entry into the United States, a violation of Title 8, United States Code, Section 1326(a).
The evidence presented at the guilty plea hearing established that Morgado-Martinez had been deported from the United States back to Mexico in 2009. ICE-ERO officers discovered Morgado-Martinez’s deportation status while investigating an incident on April 29, 2017, in Charleston, SC.
The officers had arrested Morgado-Martinez for Driving Under the Influence and other traffic violations. Morgado-Martinez had not received permission to enter, re-enter, or remain in the United States.
United States Attorney Beth Drake stated that Morgado-Martinez can face a maximum penalty of a fine of $250,000 and/or imprisonment for 2 years, plus a special assessment of $100.
Assistant United States Attorney Lauren Hummel of the Florence office handled the case, which was investigated by agents of the Immigration and Customs Enforcement – Enforcement and Removal Operations and the South Carolina Highway Department District Five.
United States District Judge Bryan Harwell will impose sentence after reviewing the presentence report prepared by the U.S. Probation Office.
