The court documents reveal that the charges stem from an investigation by the U.S. Department of Homeland Security’s Immigration and Customs Enforcement Division. According to the Indictment, on July 22, 2025, Cahuex-Martinez was found in the United States without having obtained the express consent of the Secretary of Homeland Security to reapply for admission, despite having been previously removed on July 3, 2018, November 13, 2018, and January 26, 2022.

This case is a part of Operation Take Back America, a nationwide initiative aimed at combating illegal immigration, eliminating cartels, and protecting communities from violent crime. This operation pools resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN), showcasing the Department of Justice’s commitment to defending American citizens.

U.S. Magistrate Judge Gerald L. Jackson has accepted Cahuex-Martinez’s plea and ordered the completion of a presentence investigation report, which will guide the sentence determination by a U.S. District Court Judge, considering the U.S. Sentencing Guidelines and other statutory factors.

Cahuex-Martinez remains in custody pending sentencing, with Assistant U.S. Attorney Dak T. Cohen representing the United States in this case.

With this guilty plea, the Department of Justice continues to send a strong message about its stance on illegal immigration and the enforcement of U.S. laws.
