Guido Andres Cuellar Batres, Forcibly Assaulting Federal Officers, Massachusetts 2025

Guatemalan national Guido Andres Cuellar Batres, 24, has been charged with forcibly assaulting federal officers during an immigration arrest in Marlborough, Massachusetts.

Cuellar Batres is accused of resisting officer efforts to bring his arms behind his back for handcuffing, biting one officer in the wrist, attempting to bite another officer in the leg, and striking an officer in the head multiple times.

The incident occurred on May 4, 2025, when four federal officers – three Immigration and Customs Enforcement officers and a Drug Enforcement Administration agent – approached a vehicle in a parking lot in Marlborough. Cuellar Batres was sitting in the front passenger seat and allegedly refused to step out of the car, despite being instructed to do so in both English and Spanish.

The officers then allegedly instructed Cuellar Batres and the driver to unlock the vehicle, but they did not do so. After being instructed to keep his hands visible, Cuellar Batres reached down in the front passenger seat, leading the officers to break the rear passenger side window and gain entry to the vehicle.

Cuellar Batres is currently in ICE custody and is set to appear in federal court in Boston at a later date. The charge of forcibly assaulting, resisting, opposing, impeding, intimidating, or interfering with federal officers engaged in the performance of official duties provides for a sentence of up to eight years in prison, three years of supervised release, and a fine of $250,000.

The details contained in the charging document are allegations, and Cuellar Batres is presumed to be innocent unless and until proven guilty beyond a reasonable doubt in the court of law.
