Guth Sentenced for Theft

Fredrick L. Guth, Jr., a 67-year-old man from Brewerton, New York, has been sentenced to three years of probation for stealing government property. The sentence comes after Guth pleaded guilty to receiving Social Security retirement benefits under someone else’s name.

According to the announcement made by United States Attorney Carla B. Freedman and John F. Grasso, Special Agent in Charge of the Social Security Administration, Office of the Inspector General, New York Field Office, Guth’s crime involved receiving a total of $33,812.00 in Social Security retirement benefits issued under the social security number and name of another person.

The investigation revealed that Guth received these benefits from November 2016 to July 2018, despite knowing that he was not entitled to them. Additionally, Guth spent the benefits, further compounding his crime.

In addition to the three years’ probation, Senior United States District Judge Thomas J. McAvoy also ordered Guth to pay full restitution to the Social Security Administration (SSA). This ruling ensures that the SSA will recover the stolen funds and that Guth will be held accountable for his actions.

The case was investigated by the SSA Office of the Inspector General and was prosecuted by Special Assistant U.S. Attorney Adrian S. LaRochelle.
