Atlanta, GA – A complex case of illegal hazardous waste disposal and pollution, originating in 1984, finally reached a conclusion in 1986 with a series of court reversals and sentencing. The case, involving two companies – Performance Advantage and Hayes International – and multiple individuals, exposed a pattern of deliberate environmental violations and attempts to circumvent federal regulations.
The investigation began with evidence of pollutants being directly discharged from a Performance Advantage facility, which processed waste oil and jet fuel, into nearby waterways. Initial indictments in June 1984 charged Performance Advantage and its president, Bolton, with four counts of discharging pollutants without a required National Pollutant Discharge Elimination System (NPDES) permit, violating the Clean Water Act (33 U.S.C. 1311 and 1319(c)(1)). A second indictment broadened the scope, adding 19 counts against Hayes International, Beasley, and others, alleging violations of the Resource Conservation and Recovery Act (RCRA) related to the transportation, storage, and disposal of hazardous waste (42 U.S.C. 6928(d)(1) and 6928(d)(2)(A)). Conspiracy charges (18 U.S.C. 371) were also levied.

A trial against Hayes International, Beasley, and two other individuals commenced in October 1984, but the judge ultimately acquitted the two additional individuals after the government presented its case. Following closing arguments, the court initially acquitted Hayes International and Beasley on five counts related to storage and disposal. However, a jury found both Hayes International and Beasley guilty on eight counts each of transporting hazardous waste to an unpermitted facility (42 U.S.C. 6928(d)(1)). These verdicts were then shockingly overturned by District Judge Robert Varner, prompting an appeal by the government to the Eleventh Circuit Court.
In April 1986, the Eleventh Circuit Court reversed Judge Varner’s decision, reinstating the jury’s guilty verdicts against Hayes International and Beasley. This reversal paved the way for sentencing. Performance Advantage received a $2,500 fine for the Clean Water Act violation and a $50 fine for the RCRA violation. Bolton was sentenced to a $2,500 fine and 60 months probation for the Clean Water Act violation, with an additional 60 months probation for the RCRA violation, to run concurrently. Hayes International was fined $2,500, and Beasley received a $1,000 fine. Notably, all defendants were acquitted of the initial conspiracy charges.
