Subodh Agrawal, Medicare Scam, Georgia 2024

ATLANTA – Health Wealth Safe, Inc. and its owner Dr. Subodh Agrawal have paid $1.29 million to settle allegations that they knowingly caused false claims to be presented to Medicare, a federal crime news site has learned.

The settlement resolves allegations that Health Wealth Safe, Inc. and Dr. Agrawal, presented false claims to Medicare for remote physiologic monitoring services that did not meet Medicare’s requirements between September 2019 and January 2021.

‘Knowingly billing Medicare for services that do not meet Medicare’s requirements is a fraud against taxpayers,’ said U.S. Attorney Theodore S. Hertzberg. ‘Our office will continue to enforce the False Claims Act to recover government payments that result from such misconduct.’

The investigation began when former employees of Health Wealth Safe, Inc. filed a whistleblower lawsuit under the False Claims Act, a federal law that imposes civil liability on any person who submits false claims to the federal government or its contractors.

The United States alleged that at the direction of Dr. Agrawal, Health Wealth Safe caused claims to be presented to Medicare for remote physiologic monitoring services that were not reimbursable. The company allegedly billed for RPM services even though it failed to provide patients with devices that met the requirements.

The settlement resolved the underlying lawsuit filed in the U.S. District Court for the Northern District of Georgia, United States ex rel. Chavous v. Health Wealth Safe, Inc.. The relator will receive $238,650 from the settlement in this matter, plus attorney’s fees.

The civil settlement was reached by Assistant U.S. Attorney Anthony DeCinque. The claims resolved by the settlement are allegations only, and there has been no determination of liability.
