Sergio Alberto-Rodriguez, Illicit Reentry, California 2008

A federal jury convicted a Honduran national of illegally reentering the United States after he had already been convicted of abusing a 10-year-old family member.

Sergio Alberto-Rodriguez, 38, was removed from the country on Nov. 5, 2008, but somehow managed to return and got caught by U.S. Customs and Immigration Enforcement (ICE) on June 24, 2020.

ICE discovered that Alberto-Rodriguez was behind bars at the Arlington County Adult Detention Center after his arrest for aggravated sexual battery of a 10-year-old family member.

Alberto-Rodriguez had already pleaded guilty to that charge on Feb. 7 in the Circuit Court of Arlington County and was taken into federal custody on Feb. 20.

The jury found Alberto-Rodriguez guilty of reentering the United States illegally, a charge that carries a maximum penalty of two years in prison, a $250,000 fine, and 1 year of supervised release.

Alberto-Rodriguez will be sentenced on Sept. 11 and may face deportation or removal after that.

Alexandria, Va. – U.S. Attorney Jessica D. Aber and Liana Castano, Field Office Director for Enforcement and Removal Operations (ERO) Washington, D.C. made the announcement after U.S. District Judge Rossie D. Alston Jr. accepted the verdict.

Prosecuting the case are Special Assistant U.S. Attorney Ariana Lazzaroni and Assistant U.S. Attorney Alessandra Serano.
