Inmate Scheme Nets Mother-Son Duo Prison Time

MODESTO, CA – A brazen scheme to siphon off California’s unemployment benefits using the identities of fellow inmates landed a mother-son duo in federal prison this week. Jaime Ornelas, 27, formerly of Modesto, received three years and one month behind bars, while his mother, Misty Ornelas, 48, of Turlock, will serve 18 months. Both were sentenced by U.S. District Judge Dena Coggins and ordered to pay $150,000 in restitution.

The conspiracy, which began in June 2020, exploited the overwhelmed California Employment Development Department (EDD) during the height of the COVID-19 pandemic. Acting U.S. Attorney Kimberly A. Sanchez announced the sentencing, detailing how Jaime Ornelas, while incarcerated at High Desert State Prison in Lassen County, acted as the inside man, providing his mother with personally identifiable information of other inmates.

Misty Ornelas then allegedly used this stolen data to file fraudulent unemployment insurance claims with the EDD. These applications falsely claimed the inmates had recently worked and were unemployed due to the pandemic, a calculated lie designed to trigger benefit payouts. The scale of the fraud quickly ballooned, exceeding $150,000 in stolen funds.

“This wasn’t a desperate act of need, it was a calculated scheme to profit off a system already strained by unprecedented demand,” said a source close to the investigation, speaking on condition of anonymity. “They preyed on the chaos of the pandemic and exploited the vulnerabilities of the EDD, all while locked up or assisting from the outside.”

The case was a joint effort by the Federal Bureau of Investigation and the EDD, highlighting the growing federal focus on pandemic-related fraud. Assistant U.S. Attorneys Chan Hee Chu and Denise N. Yasinow spearheaded the prosecution. This sentencing is part of the California COVID-19 Fraud Enforcement Strike Force, a multi-agency initiative established by the Department of Justice to tackle large-scale pandemic relief fraud in California.

The Strike Force, operating in the Eastern and Central Districts of California, employs data analysis and prosecutor-led teams to identify and prosecute those who stole pandemic relief funds. This case serves as a stark reminder that even behind bars, criminals will seek to exploit any opportunity for personal gain, and federal investigators are increasingly adept at tracking down and bringing them to justice. The Ornelas duo now faces the consequences of their greed, trading freedom for a lengthy stay in the federal prison system.
