Interstate Processing, Illegal Dumping, OH 2008

Toledo, OH – In 2007 and 2008, a series of guilty pleas and financial penalties concluded a case of illegal hazardous waste dumping near a Toledo Head Start facility, exposing vulnerable children to potential health risks. The investigation, led by the Ohio Environmental Protection Agency (EPA) and pursued through the Lucas County Courts, revealed a pattern of negligence and unlawful disposal practices by Interstate Processing LLC, along with related entities and individuals.

The case originated with the discovery of numerous drums abandoned on city property in the vicinity of the Toledo/Lucas County Head Start. These drums contained various wastes, some identified as hazardous, immediately raising concerns for public safety and environmental contamination. Investigators quickly traced the waste back to Interstate Processing and a related company, Meridan Environmental, ultimately pinpointing Randolph as the individual responsible for the illegal dumping.

On July 23, 2007, Interstate Processing LLC was initially charged with violations of Ohio Revised Code sections 3734.99 and 3734.02. The company ultimately pled guilty and was sentenced to pay $15,000 to the Ohio EPA and a further $10,000 to The Nature Conservancy, totaling $25,000 in restitution. Simultaneously, Randolph faced a barrage of charges on July 25th, including violations of 3734.02, 2909.06, 3734.03 (two counts), and 3734.99.

The scope of the investigation widened to include Meridan Environmental, charged on August 15, 2007, with violations of 3734.11 and 3734.99. Vella, an individual connected to the case, was also charged with a violation of 2909.06. Meridan quickly pled guilty on August 30th, agreeing to pay a total of $25,000, distributed between the Ohio EPA ($7,500), the Ohio Attorney General’s Office ($7,500), and both the MEEA and NEEP organizations ($5,000 each). Vella also pled guilty, receiving a suspended six-month jail sentence, six months of probation, and a $1,000 fine.

The final resolution came on January 30, 2008, when Randolph pled guilty to the charges. The sentencing included 60 months of probation, 600 hours of community service, restitution to the Ohio EPA in the amount of $11,800, and a substantial $15,000 state fine, suspended contingent upon full restitution payment. While financial penalties were levied, critics at the time questioned whether the sentencing adequately addressed the potential long-term environmental and health impacts of the illegal dumping.
